This visa is for an Australian citizen, Permanent resident or eligible New Zealand citizen to sponsor their fiance, spouse, or de facto partner. Subject to the type of relationship, these kinds of visas are divided into the categories given below.
FIANCE / PROSPECTIVE MARRIAGE VISA (Subclasses 300)
This visa is for the applicant who is intending to marry his/her Australian citizen, permanent resident or eligible New Zealand citizen (sponsor). This visa can only be applied outside of Australia. Once the visa is granted, the applicant has to marry the sponsor within 9 months. Following marriage the onshore visa application for subclass 820/801 can be lodged.
SPOUSE/DEFACTO PARTNER VISAS (Subclass 309/100)
This Offshore visa allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.
The temporary visa (subclass 309) is granted initially to stay in Australia and after 24 months, the applicant may be eligible for the grant of permanent visa (subclass 100).
SPOUSE/DEFACTO PARTNER VISAS (Subclass 820/801)
This Onshore visa allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.
The temporary visa (subclass 820) is granted initially to stay in Australia, and after 24 months, the applicant may be eligible for the grant of permanent visa (subclass 801).
To be eligible for Spouse/De facto Partner visa, the applicant must either be married or in a de facto relationship for at least 12 months prior to application.
For these visas, the applicant needs to demonstrate the social, economical and commitment aspects of relationship. Also the relationship must be genuine and continuing.
