TEMPORARY WORK (Skilled) VISA – Subclass 482
This is a temporary work visa for employers to sponsor skilled workers from overseas to work in Australia in their nominated occupation. The applicant needs an employer who can sponsor them as part of the visa process. The applicant needs to be sponsored by an approved business when the position nominated by the business cannot be filled locally by an Australian citizen or permanent resident. This visa may lead to permanent residency in Australia either through sponsorship by an eligible employee or the skilled migration. The applicant needs to satisfy the relevant criteria relating skills and English language for this visa. This visa involves a 3-stage process to work in Australia.
- Sponsorship
The first stage requires the business to seek approval to sponsor and hire overseas workers. The sponsor must be lawfully engaged in, and actively operating, a business in Australia.
- Nomination
The second stage requires the business to nominate an individual applicant for the position in Australia. The nomination must relate to an occupation which meets a minimum skills threshold. The nominated position must be employed on equivalent terms and conditions.
- Visa Application
The final stage requires the nominee to submit an application for the 482 visa. The applicant must demonstrate the skills to match the nominated position. The applicant must have a genuine intention to perform duties of the nominated position.
EMPLOYER NOMINATION SCHEME (ENS) – Subclass 186
The Employer Nomination Scheme visa (subclass 186) is for skilled workers, who are sponsored by their employers for a permanent residence visa. It has three streams:
Direct Entry Stream:
For people nominated by an Australian employer
Temporary Residence Transitional Stream:
For people already in Australia with a 482 visa for employment and have worked for three years and are nominated by the same employer.
Agreement Stream:
The people on Labour Agreements, need to meet the following criteria:
- has been nominated by an approved Australian sponsor
- is younger than 50 years of age, unless exempted
- meet the skills, qualifications and English language requirements, unless exempted
SKILLED EMPLOYER SPONSORED (REGIONAL) VISA (Subclass 494)
This visa requires employer sponsorship from a regional employer, also the position must likely exist for at least 5 years. The applicant must have a positive skills assessment with at least 3-year skilled employment.
The visa is for 5 years with conditions that the visa holder will live, work only in the nominated position and study only in regional areas. The visa holder must start work within 90 days of the grant of visa. The visa may be cancelled due to non-compliance of visa conditions.
